Illegal Weapons Charges
Our state has tough laws governing the sale, possession and use of firearms and other weapons, and if you are found in violation you can be punished with a harsh sentence. The Law Office of John M. Cromwell may be able to help you avoid the serious consequences of a conviction. I have spent nearly a quarter century as a White Plains criminal defense lawyer, aggressively fighting for my clients' rights on all types of offenses. You are at risk of being sent to jail or prison and being forced to live the rest of your life with a criminal record which can seriously hamper your career opportunities, and you cannot afford to take any chances with the outcome of this situation. I am fluent in Spanish, and can meet with you as soon as possible for a consultation.
Laws on Weapons Use
There are several statutes governing the various types of weapons offenses, including:
- Criminal Possession of a Firearm
- Criminal Use of a Firearm
- Criminal Sale of a Firearm
You can also face enhanced penalties for a theft crime or a
violent crime such as
assault if you are accused of carrying or using a deadly weapon at the time of the crime. For example, a charge of
robbery carries a maximum sentence of 7 years, but the penalty can be increased to as much as 25 years in cases of
armed robbery.
State law includes a long list of weapons which can give rise to criminal charges, including pistols, shotguns, rifles, knives, brass knuckles, stun guns and switch blades. In certain scenarios, it may be possible to prove that the weapon is a tool, such as a knife for work, while other weapons are illegal to possess or to carry on the street under any circumstances. I will study your charges from every angle to develop a strategy for defending your rights and helping you avoid a negative outcome.
