Grand Jury Tosses Case of Car Passenger Charged With Possessing Heroin

Client was a passenger in a car which the police pulled over for an alleged defective plate light. The officers searched the car and found 590 bags of heroin in the back seat where client was sitting. Client, driver, and another passenger seated in the front were arrested and charged with possession of heroin as class A felony. Following his arraignment, client remained incarcerated, unable to post $100,000 bail set. The Driver and the front-seat passenger declined to testify before the grand jury. On the advice of counsel, client testified before the grand jury, which dismissed all charges against client. The driver and the other passenger were both indicted.
