Defense attorney John Cromwell filed a written motion arguing that prosecutor's had violated the defendant's right to a speedy trial. After a warrant was issued because the client missed a court date, client voluntarily returned to court and the warrant was vacated. The prosecution was not ready for trial and the case was adjourned for trial. Agreeing with arguments raised in defense counsel's motion, the court held the prosecution had taken too much time to bring the defendant to trial, and dismissed all charges.
