Misdemeanor Crimes and Defense
Misdemeanors are a less severe category of crime than felonies, but you should not underestimate the effect that an arrest and conviction could have on your future. If you have been charged with a misdemeanor such as first DUI offense, marijuana possession, assault or petit larceny, you are at risk of receiving a sentence which could include jail time, fines and probation.
Perhaps most importantly, you would end up with a criminal record which could interfere with your opportunities for a career, housing and credit. My name is Attorney John M. Cromwell, and I understand how vital it is for you to avoid a conviction. I have more than 24 years' experience as a White Plains criminal lawyer, representing individuals on everything from traffic tickets to murder.
Classes of a Misdemeanor
Class A misdemeanors are punishable by up to a year in jail and a fine of $1,000, while a Class B misdemeanor carries a maximum sentence of 3 months in jail and $500 in fines. Sentencing for unclassified misdemeanors varies according to the specific statute and the discretion of the judge. It may be possible to negotiate a reduced punishment or to serve a portion of the sentence on probation or parole.
Many employers and landlords require the applicant to disclose any prior criminal convictions, and having a misdemeanor on your record can cost you the chance to be hired and can make it difficult to find a place to live. This is especially true with theft crimes and violent crimes, as well as certain sex offenses which include mandatory sex offender registration in the sentence. When you face such serious consequences, you deserve to have someone on your side, fighting to protect your personal interests.
